Partner Visa
A Fiancé, partner or spouse who are in relationship with an Australian permanent resident or Australian citizen.
1. Partner Visa Subclass 820/801 (Apply in Australia)
The partner or spouse who are being in a relationship with an eligible partner (sponsor)
- Stay in Australia to lodge valid application
- The de facto partner or spouse of an Australian citizen or Australian permanent resident.
- De facto relationship at least of 12 months duration.
- Getting this visa is the first step towards a permanent Partner visa (subclass 801).
- Relationship must be able to prove in four factors; joint financial aspects of the relationship, joint nature of the household arrangement, the social aspects of the relationship and the nature of the couple’s commitment to one another
- 820 (temporary) visa will be granted first which allow a visa holder to:
- Live and work in Australia
- Multiple entry Australia
- Australia’s public health care scheme (Medicare)
2. Partner visa subclasses 309/100 (apply overseas)
The partner or spouse who are being in a relationship with an eligible partner (sponsor)
- Stay outside Australia to lodge valid application
- De facto partner or spouse of an Australian citizen, Australian permanent resident live in Australia temporarily.
- De facto relationship at least of 12 months duration.
- Getting this visa is the first step towards a permanent Partner visa (subclass 100).
- Relationship must be able to prove in four factors; joint financial aspects of the relationship, joint nature of the household arrangement, the social aspects of the relationship and the nature of the couple’s commitment to one another
- 309 (temporary) visa will be granted first which allow a visa holder to:
- Live and work in Australia
- Multiple entry Australia
- Australia’s public health care scheme (Medicare)
3. Prospective marriage visa subclasses 300 (apply overseas)
A fiancé who are being in a relationship and plan to marry an Australian permanet resident or Australian citizen and stay in Australia.
- Stay outside Australia to lodge valid application
- Allow a visa holder to enter and remain in Australia for 9 months to marry their fiancé.
- A genuine intention to marry within the 9 months validity period of the visa.
- A fiancé met each other in person before engagement and apply visa.
- A fiancé who intend to settle permanently in Australia, he/she will need to apply for an onshore Partner Visa (820/801) after marriage.
- Allow a holder visa to:
- stay in Australia for between 9 and 15 months from date of grant of visa.
- work in Australia.
- study in Australia at own expense.
